Road Accident Fund

The Road Accident Fund (RAF) compensates victims of road accidents in South Africa for personal injuries caused by negligent driving. Victims can claim pecuniary damages (financial losses) and non-pecuniary damages (pain, suffering, and disfigurement).

Following the 2008 amendments, claimants are now limited to claiming pecuniary damages, with a cap on income loss, and non-pecuniary damages are only available to those with 30% or more permanent impairment. For those with lesser injuries, a narrative test allows claims for mental disorders or serious disfigurement.
